These terms and conditions apply to all photography services provided by Max Event Photography. By making a booking, the Client agrees to be bound by the following terms.

2. Services
The Photographer will provide event photography in accordance with the brief agreed at the time of booking. Unless otherwise stated, services include:
A pre-event consultation equating to no more than 30 minutes of the Photographer's time.
Full professional editing (selection, colour/exposure correction, consistency adjustments, cropping)
Delivery of final edited images in a secure online gallery
Gallery access for 30 days from the date of delivery
Standard turnaround of 2 working days
Travel within Greater London

3. Consent for photographing identifiable subjects
Unless otherwise agreed in writing before the booking, the Client is responsible for obtaining and managing any consent required from identifiable individuals appearing in the Images — including, but not limited to, consent from a parent or guardian for any minor who is the identifiable subject of a photograph, and consent from vulnerable adults or their representatives where required.
Gathering, recording or managing signed consent forms on the day (including for minors or vulnerable adults) is not included in the Photographer's standard service, and will only be undertaken where expressly agreed in writing in advance — this may be subject to an additional fee.
Where the Client has not put adequate consent arrangements in place on the day, the Photographer reserves the right to limit coverage of the relevant individuals to wide, group, or non-identifiable shots, or to exclude them from the brief entirely, without this being treated as a shortfall in the agreed service.
4. Fees, deposits and payment
Standard rate: £175 per hour, minimum two-hour booking.
Non-standard hours (outside 9am–6pm): additional £60.
Bookings of 4 hours or more require a 30% deposit to secure the date, payable at the time of booking.
Unless otherwise stated in these Terms, all invoices issued by the Photographer are due for payment within 14 days of the invoice date. This includes the final balance invoice, which is issued together with the final images.
Travel outside Greater London is charged at cost.
The Photographer reserves the right to suspend delivery of images if payment is overdue.
If payment is not received within the agreed timeframe, the Photographer reserves the right to charge statutory interest and compensation for late payment, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
Non-standard hours (outside 9am–6pm): additional £60.

Cancellation more than 48 hours before the event: no fee.

If either party is affected by illness, accident, transport failure or force majeure, both sides will make reasonable efforts to reschedule.
If rescheduling is not possible, liability is limited to a refund of any fees already paid.

6. Deliverables
The Photographer supplies:
A curated selection of edited images
JPEG files equivalent to 2048 x 1367 at 72ppi, (other formats available on request)
Online gallery delivery
Raw files are never supplied unless otherwise agreed in writing.

7. Copyright
All images remain the copyright of Max Event Photography. Copyright is never transferred as part of the service.
The Photographer retains the right to:
Use images for portfolio, website, and social media
Use images in printed marketing materials
Use images for editorial, award submissions, and promotional activity
The Photographer will not use images in contexts that would be reasonably deemed harmful, misleading or inappropriate.

8. Licensing and permitted use
Upon full payment, the Client receives an extended commercial licence, which includes:

Use images in press releases, publications, marketing campaigns and advertising
Share images internally within their organisation
Crop or resize images to fit layouts
Provide images to third-party press outlets only when directly related to the Client’s activity

What the Client cannot do:
Sell, gift or transfer the images to any third party
Allow third parties (e.g. partner organisations, venues, sponsors) to use the images unless agreed in writing with the Photographer prior to the job
Apply filters or edits that materially distort or misrepresent the Photographer’s work
Use the images in a defamatory or misleading context
Claim copyright ownership
Sell, gift or transfer the images to any third party
Allow third parties (e.g. partner organisations, venues, sponsors) to use the images unless agreed in writing with the Photographer prior to the job
Apply filters or edits that materially distort or misrepresent the Photographer’s work
Use the images in a defamatory or misleading context
Claim copyright ownership
Unless the Photographer otherwise states in writing, the licence is perpetual, worldwide, and royalty-free, but remains non-transferable.
9. Credits
Photo credits are appreciated but not required.
Where a credit is included, the correct attribution is “maxeventphoto.co.uk”.

10. Liability and limitations
The Photographer will exercise reasonable skill and care at all times. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Subject to that:
- Liability is limited to the total value of the fees paid
- The Photographer is not liable for consequential or indirect losses
- In the event of equipment failure, theft or other events beyond the Photographer's control, liability is limited to a refund of any fees paid

Insurance
The Photographer holds public and product liability insurance with a limit of indemnity of £2,000,000 and professional indemnity insurance with a limit of indemnity of £100,000, arranged through Williamson Carson and underwritten by Hiscox. A certificate is available on request.

11. Governing law
These terms are governed by the laws of the United Kingdom, and any disputes shall be resolved under the jurisdiction of UK courts.

13. Pro-bono and volunteer engagements
Where the Photographer provides services on an unpaid, pro-bono, or volunteer basis, the following terms apply in place of Sections 3 and 7 above.

The Client is granted a non-exclusive, royalty-free licence to use the images upon delivery, regardless of the absence of payment.
Unless otherwise agreed in writing, this licence is limited to the specific campaign, event, or period for which the images were taken, and does not extend automatically to future campaigns, events or activities.

Use the images in a manner that states or implies the Photographer's personal endorsement of any political party, candidate, or policy position
Claim copyright ownership
Use the images beyond the specific campaign, event, or period agreed, without further written agreement
Sell, gift or transfer the images to any third party
Allow third parties (e.g. partner organisations, other branches, or affiliated campaigns) to use the images unless agreed in writing with the Photographer prior to use
